Aruba will approach UN if the Netherlands

enforce corruption investigation

ORANJESTAD — Aruba is contemplating an official compliant with the committee for decolonization of the United Nations, if the Netherlands enforce the investigation on corruption and misgovernment without the cooperation of the island.

“Over my dead body!”

Premier Nelson Oduber (MEP) responds to the news that the Netherlands if necessary will execute the investigation without cooperation.

He insists: Aruba will not cooperate.

The Premier emphasizes once again, that the Netherlands cannot carry out an investigation on the functioning of the democracy and the constitutional state, without the cooperation of Aruba. The Kingdom government can intervene if there is a question of a serious threat of these two points based on the Statute, but there is no question of that according to Oduber.

He also had a message for Guusje (the Dutch minister of Internal Affairs, PvdA): “read the Statue and explain to me how you are going to carry out this investigation, as the cooperation of the Public Prosecutor and the police is required, and these resort under Aruba”.

The enforcing of an investigation is considered by Aruba as tarnishing of the self-government and this is in defiance of the international treaties according to the Premier. Moreover, he seriously wonders whether Aruba should remain in the Kingdom.

“They call us villains, for everything; whilst not so long ago, we were quoted as an example in the Kingdom for the success of the separate status, by the same parliamentarians. If they continue to kick us around, there will come a time that we must confer with the population whether we should step out.”

Oduber stated that it would be wise if Minister of Justice Rudy Croes (MEP) would meanwhile take up the matter with the United Nations committee in London. In any case, he is not frightened. “I will calmly wait how they will go about this, as we will not cooperate. If the Netherlands subsequently takes measures against Aruba, then we will cross that bridge when we get there.”

State Council of Ministers

The Minister Plenipotentiary of Aruba in the Netherlands, Frido Croes, will disclose Aruba’s official reaction today, in which amongst others, the matter of the salary increases of the members of the Communal Court of Justice (and the Public Prosecutor) is mentioned.

Aruba is of the opinion that in an investigation on corruption, the role of the State Council of Ministers must be considered, as they namely neglected giving their approval upon the assessment thereof. The assessment of the new salary structure/legal position was established against the legal rules, says Aruba. After all, the Antillean government should have first consulted with Aruba on this matter. Furthermore, the judges personally drew up the Land Resolutions without the official personnel procedure and then submitted these directly to the Antillean Minister of Justice, according to Aruba. The Antillean Minister of Justice then had the Governor ratify the resolutions.

Aruba states that they verbally raised this matter with the Dutch Minister of Justice, Ernst Hirsch Ballin. However, no action was even taken.

Plan of approach

This morning, Premier Oduber said that in spite of the current escalation, he stills considers the conversation with the Dutch State Secretary Ank Bijleveld-Schouten (Kingdom Relations, CDA) of last Monday as positive. “We made good agreements. The problem is that in this case, her boss is answerable to the Upper Chamber, and that’s when they will drop us.”

Oduber is now strongly considering whether to broadcast this sort of consultations. “As each time we consult, it seems they hear different things and then something different appears in writing.” According to him, Bijleveld did promise on Monday, that the agreed upon ‘plan of approach’ to improve the functioning of the democracy and the constitutional state will be available only after the elections in September.

Villains

The comment of the Dutch PVV-parliamentarian Hero Brinkman –who called Nelson Oduber (MEP) one of the largest criminals on the island – elicited heated reactions on Aruba, especially from the party favored by the press.

The headline of the newspaper Solo di Pueblo on the front page read: “Brinkman’s mother is a villain!” Oduber stated that Brinkman himself should be investigated. “Ask him why he left the police corps. If we on Aruba are villains, then he is the villain of the police.”

Politicians of the opposition responded positively to the announced investigation by the Netherlands. “Nel is now being taken by his own horns”, says parliamentarian Otmar Oduber (AVP) referring to Oduber’s nickname: the Premier is called ‘old bull’. RED states to support the Dutch Minister Guusje ter Horst: “The Oduber cabinet defaced the international image of Aruba.”

Attorney General ‘biased’

According to Premier Nelson Oduber (MEP), the Netherlands does not want to include the Aruban Attorney General Rob Pietersz in the study group with which Aruba initially wanted to carry out the investigation on corruption with the Netherlands. Oduber stated this earlier in a letter to his Dutch colleague Jan Peter Balkenende.

An Aruban-Dutch study group consisting of amongst others members of the Advisory Council, the Council of State, and therefore also the Attorney General, would investigate what the true facts were on misgovernment and corruption – which State Secretary Ank Bijleveld-Schouten (CDA) of Kingdom Relations reported to the Dutch parliament. However, Bijleveld told Oduber that the Attorney General could not be included in the study group, as he was ‘biased’.

THE KRISTIN FOUNDATION TO REMEMBER NATALEE HOLLOWAY, OTHERS

The Kristen Foundation for missing adults is hosting a remembrance ceremony at Frazier Park tonight for people who have disappeared.

The foundation will lay memorial bricks for missing people who've made national headlines in recent months – Natalee Holloway, a teenager who disappeared in Aruba in May 2005 while on a graduation trip;

Jamie Fraley, a 22-year-old from Gaston County missing since April 2008, and Carla Vicentini, a 26-year-old missing from New Jersey since 2006, according to Joan Petruski, who started the foundation.

The candlelight ceremony will also include a tribute to Nikki McPhatter, who was missing for weeks before her burned body was located in South Carolina.

The Kristen Foundation offered a reward for information about McPhatter's disappearance shortly before her body was found.

Petruski started The Kristen Foundation in 1999 after Kristen Modafferi, a Charlotte woman who disappeared a decade ago while working and studying in San Francisco. The organization raises money to help families pay for the costs of searching for missing adults.

NETHERLAND ANTILLES PLACED ON HUMAN TRAFFICKING WATCHLIST!

WASHINGTON -- The Obama administration on Tuesday expanded the U.S. watchlist of countries suspected of not doing enough to combat human trafficking, putting more than four dozen nations on notice that they may face sanctions unless their records improve.

The State Department's annual "Trafficking in Persons Report," the first released since President Barack Obama took office, placed 52 countries and territories -- mainly in Africa, Asia and the Middle East -- on the watchlist. That number is a 30 percent jump from the 40 countries on the list in 2008.

Several previously-cited nations were removed from the list, but new countries cited for human trafficking problems include Angola, Bangladesh, Cambodia, Iraq, Lebanon, Nicaragua, Pakistan, the Philippines, Qatar, Senegal and the United Arab Emirates, according to the report.

The report also placed the Netherlands' Antilles, a self-governing Dutch territory in the Caribbean, on the watchlist.

"With this report, we hope to shine the light brightly on the scope and scale of modern slavery so all governments can see where progress has been made and where more is needed," Secretary of State Hillary Rodham Clinton said as she released the 320-page document.

Inclusion on the watchlist means those countries' governments are not fully complying with minimum standards set by U.S. law for cooperating in efforts to reduce the rise of human trafficking -- a common denominator in the sex trade, coerced labor and recruitment of child soldiers.

If a country appears on the list for two consecutive years it can be subject to U.S. sanctions.

Seventeen nations, up from 14 in 2008, are now subject to the trafficking sanctions, which can include a ban on non-humanitarian and trade-related aid and U.S. opposition to loans and credits from the International Monetary Fund and World Bank. The penalties can be waived if the president determines it is in U.S. national interest to do so.

Those 17 countries include traditional U.S. foes like Cuba, Iran, Myanmar, North Korea, Sudan and Syria, but also American allies and friends such as Saudi Arabia and Kuwait.

Malaysia, another U.S. partner was added to the list of worst offenders as were Zimbabwe, Chad, Eritrea, Mauritania, Niger, and Swaziland.

2008 also gave us A&E’s Bill Kurtis and the famous series “American Justice” that produced an hour special on Natalee’s case.  Using a different take, the show focused more on the ongoing recovery efforts to find Natalee’s body.

Haunting Evidence did an hour special using a psychic and some “ghost buster” toys in order to find out the truth of what Joran did with Natalee that last night.

…AND DON’T FORGET!  The Peter de Vries Special that changed EVERYTHING.

ABC’s 20/20 with Chris Cuomo did an hour long story on Natalee’s case up to date, including the aftermath of the “Peter de Vries Hidden Camera” scandal, and Joran’s “side job” of “alleged” sex trafficking of women between the borders of Thailand and the Netherlands…all conveniently caught on secret videotape.

A “Sex, Lies and Videotape” of the new millennium?  Could be…

Last, but never least…Greta van Susteren’s “career changing interview” with Joran after her multi-month man hunt across the globe to obtain interviews with witnesses and Joran himself who told Greta on camera that he did not kill Natalee, but sold her to an unknown man in Aruba for $10,000 after two brief exchanges in the casinos of Aruba.

Hours after the taped “confession”, Joran contacted Greta via email and recanted his entire story.

Only half way through 2009…

The Natalee Holloway Story was produced by the Lifetime Movie Network and was viewed by a record setting 3.2 million people when it aired in April of 2009.  It was the highest viewed movie in Lifetime’s 11-year history.

 

ENOUGH SAID

When in history has a “missing person-turned-corruption-case” garnered so much worldwide attention, especially after four years?

It is because of the people.  These are the "little people" with a HUGE voice that want to see justice.  They want to see the new developments or what Joran’s new lie will be.  They want to see punishment for those involved, and they want Natalee’s family to obtain closure.

The media feeds off what the public wants to see and hear.  Thanks to the media, Natalee’s case has never “gone cold”.  With every movie, documentary and book, Aruba’s massive wound continues to rip open with an increase of pain each time.

I know there are people out there who have no clue of Natalee Holloway.  However when I mention to someone that I write a blog about Natalee Holloway, and they say, “Who?”  The only words I need to use to jog their memories are “Aruba” and “missing”. 

Ah ha!  It works every time.

Each time just one person mentions her case to another person, those negative images and stories are stored either in one's immediate conscious or will lie in the subconscious. 

Perhaps that particular conversation knowingly or not, will be the cause of one less person visiting Aruba.

OH, and by the way, Carlos-n-Charlies in Aruba closed (due to the poor economy..yuk, yuk...)

DUTCH INVESTIGATION INTO ARUBAN GOVERNMENT, NAMELY PROSECUTION

ORANJESTAD/ THE HAGUE — In her letter to the Lower Chamber today, the State secretary of the Kingdom Relations, Ank Bijleveld-Schouten (CDA) stated that there would be an investigation into the government of Aruba. 

In her letter, she gave a number of her own observations on the judicial process on the island and is of the opinion that a ‘combination of signals are so alarming that there is reason to investigate in order to get a complete picture of the status of the government

 of Aruba’. 

On the base of the results of that investigation, the State secretary will view if further measures must be taken and on which level this should take place.

During a debate in the Upper Chamber last week, Bijleveld said she worries about the status of the government on Aruba. In the letter she forwarded to the Lower Chamber today, she gives a few observations from which she concluded to open an investigation. 

For example, the Public Prosecutor cannot sufficiently focus on the prosecution of offences. This is the actual task of the Public Prosecutor, but this comes off badly due to amongst others, understaffing. The National Criminal Investigation Bureau appears so overloaded by corruption investigations, that other cases are shelved, says the State secretary.

The Public Prosecutor in Oranjestad should have six public prosecutors, and there are only four. “Not because there are insufficient qualified candidates, but on account of a salary discussion”, according to Bijleveld’s letter to the Chamber. 

Furthermore, the boss of the Public Prosecutor, the Attorney General, is losing so much time on troublesome files and solving discussing with the Netherlands, that he barely has time to prosecute. 

“This fact, in combination with the in comparison large amount of corruption reports in the politics and the bureaucracy, worries me”, Bijleveld writes. “”After all, the adequate functioning of the Public Prosecutor is one of the pillars of the constitutional state”.

Communal Court

Another pillar, which worries the State secretary, is the legal authority, which she meanwhile told the minister-president Oduber. Bijleveld reminds the Chamber, that Aruba barely cooperated with the realization of the Communal Court of Justice. Eventually Aruba agreed with the majority of the enactment, which resulted in the realization of the Communal Court.

There is also understaffing in the prison. Bijleveld points out that the situation in the police cells and the prison has improved after the visitation of the European Committee regarding the prevention of torturing, and inhuman and degrading treatments of punishments (CPT). 

The physical circumstances have been dealt with, but she also observed that there are still insufficient qualified personnel and that the treatment of prisons leaves much to be desired. Her main point of concern in this area however remains the aliens’ detention, where not one point of improvement has been implemented since the CPT-visit.

I don't have any other information as to when the exhibit will be on display because I don't see it mentioned at the National Museum of Crime & Punishment's website, but if anyone knows of any further information, please post it or send it to me!

Boycott Aruba--Justice for Natalee Holloway has declared the month of May "International Crime Victims Month" in dedication to Natalee Holloway who has been missing since May, 2005.

FOUR YEARS

...Nearly 1460 days have passed since Natalee has been gone.  Natalee and her story will not be forgotten and the boycott of Aruba will continue until justice is served.

PATRICK VAN DER EEM BEATS WIFE WITH CROWBAR--RECEIVES 30 HOURS OF COMMUNITY SERVICE?

Looks like Patrick van der Eem used the old, "I was stoned" excuse after he pulled a "Chris Brown" on his wife.  What a great guy, huh?  Beat someone with a deadly object and you'll only get community service in the Netherlands.

Patrick van der Eem, who befriended Joran van der Sloot and then secretly recorded him confessing to being with Natalee Holloway when she died, has been given a 30 hour community service sentence for hitting his girlfriend with a crowbar.

Trouw reports that Van der Eem was found guilty of attacking the woman in Arnhem last December. He claimed to have been under the influence of drugs at the time.

Van der Eem has a known cocaine addiction and was said to have used drugs while making the recordings of Van de Sloot speaking about the American teenager's disappearance.

NETHERLANDS ROYAL FAMILY ATTACKED--FIVE DEAD

The Dutch Royal Family looked on in horror yesterday as a car ploughed into a crowd of wellwishers, killing five and injuring twelve.

The car smashed through two police barriers in an apparent attempt to ram the open-top bus carrying the royal party, which included Queen Beatrix, 71.

Dutch media reported that the driver, a 38-year-old man, had been fired from his job and faced eviction from his home.  He was slumped at the wheel when he was arrested. Police said that the man, who was in a critical condition, had no history of mental illness and had acted alone. No explosives were found in the vehicle.

The Royal Family had been visiting Apeldoorn, 60 miles (96 km) east of Amsterdam, as part of the festivities for the annual Queen’s Day holiday.  In a rare television address Queen Beatrix offered her condolences. “We are speechless that something so terrible could have happened,” she said, looking shaken. “My family and I think everybody in the country sympathises with the victims, their families and friends. What began as a great day has ended in a terrible tragedy.”

On Queen’s Day, which commemorates the birth of Queen Beatrix’s mother, millions of people take the day off, dress in orange wigs and hats and hold street parties. 

Last night the parties were cancelled and flags were at half-mast.

Ludo Goossens, a justice official, said: “At the moment of first contact with police on the ground, the man indicated that his action was aimed against the Royal Family.”

Jan Peter Balkenende, the Prime Minister, said: “I think that it has become clear that this happened with premeditation.”

Officials said that the driver had a map of the Queen’s parade route. He apparently tried to collide with the bus carrying the Royal Family. People were thrown in the air as his car ripped through the crowds before hitting a monument and coming to a halt.

Dutch television showed Crown Prince Willem-Alexander and his wife, Princess Maxima, watching in astonishment. No one in the royal entourage was hurt.

Peter von de Vorst, a witness, said that the incident was like watching a Hollywood film. “It was a really nice day. Then you hear a bang. Everyone looks up and you see people indeed flying through the air,” he said. “This must be a joke or a strange prank. Then suddenly panic, and you realise that something really terrible has happened.”

ARUBA TOURISM CRISIS--"WE MUST MAINTAIN OUR GOOD RELATIONS WITH OUR NORTH AMERICAN PARTNERS"

It's ironic that the AHATA addresses and admits serious concerns for their tourism, but never adds the boycott of Aruba into the equation.  At least they won't admit it on paper.  

To add insult to injury, the recently aired Natalee Holloway movie on the Lifetime Network (which reported the highest ratings in Lifetime Network's history) which depicted the cover-up and ultimate scandal in the handling of Natalee Holloway's case has YET AGAIN fueled the fire to Aruba's dire situation.  

The result?  

Reminding the public AFTER FOUR YEARS about this self-serving island and what they did to the Holloway family.  

...And what they are capable of doing to YOUR FAMILY.

ARUBA DEMANDS "TOURISM BAILOUT" FUNDS

ORANJESTAD — Tourism-minister Edison Briesen wants additional funds for the promotion of Aruba as holiday destination, as the prospects for the second quarter have grown worse than that of the first three months of this year.

The sector expects the number of accommodations to decrease with 35 percent during the second quarter.  For the ‘summer months’ such as July, there are hardly any reservations, said branch organization ATCA. 

This organization previously approached the government this year for additional funds for the sector seriously affected by the worldwide crisis. Briesen is now convinced in view of the negative statistics presented by ATCA the hotel sector as well as the airport during the yearly tourism conference last Wednesday.

Last week the Amigoe already announced a strong decline of the number of airline passengers during the past quarter with 11.5 percent compared to last year. It now appears, that the number of tourists accommodated during the first three months of this year, decreased with an average of 6.8 percent. 

Moreover, in January it concerned 4.7 percent less, and in March already a decrease of 10.1 percent. The revenues per accommodation decreased with 15.6 percent. Furthermore, the revenues during March indicated a decrease of nearly 25 percent.

During the presentation for foreign travel agencies and transportation companies of the tourism conference, Ahata indicated that the ‘last minute pick up’ for the months of May and June turn out to be worse than the first quarter of this year. 

“Looks very bad”, said the branch organization. 

Moreover, it remains a guess for the rest of the year, said Ahata, although it is expected that the market will stabilize in September/October.

VALERO MONEY FOR TOURISM

Last year the sector received an additional 10 million dollars from the government for the promotion and execution of the so-called contingency plan, a joint approach of the government and the business, trade and industry to maintain the number of tourists. 

This amount appears to have been insufficient, says minister Briesen who furthermore not only wants additional funds, but also wants to change the plan. At the same time, he wonders if it all will be sufficient for the sector as the other 38 islands in the region are also busy investing enormous amounts in the tourism sector. 

They are also handing out serious discounts of approx. 20 to 25 percent in the struggle for the tourist. Briesen: “I am happy that our sector is not handing out these kinds of discounts yet, as it will become more difficult to increase the prices at a later stage. It now concerns discounts of 10 percent.”

The minister hopes that the extra money expecting to become available from the arbitrary case against oil refinery Valero -though the verdict is not official yet- with regard to the ‘bbo’-tax, is allocated to tourism. 

“Contrary to other islands, our government does not have ample financial means at its disposal, so it remains difficult.” He therefore hopes that the international economy and tourism market will pick up for Aruba in view of the billions invested in the business, trade, and industry by the American and European governments.

Meanwhile the minister is also trying to firm up the South-American market. This in view of the fact that after last week the airport announced that partly due to the embargo on charters by the Venezuelan authorities, the number of passengers from this country has seriously decreased. 

Briesen is therefore flying to Venezuela on Sunday to discuss this problem with the Venezuelan minister of Infrastructure and Tourism. In addition, the minister will visit the huge tourism exhibition in Brazil in a few months to convince the airline companies there to fly to Aruba.

AHATA GLOOMY

Director Rob Smith of Aruba Hotel and Tourism Authority (Ahata) says that during his twelve years in the tourism sector on Aruba, he has never experienced such an economical decline. “I have experienced nearly everything, such as wars and 11 September, but nothing compared to the current impact on tourism due to the economical instability. We therefore must stand our ground to survive this crisis. This implies that we must stay in the picture (media) and maintain our good relations with our North-American partners.”

Nowadays, the trust of the traveler is replaced by the financial capacity, says Smith. “It is therefore of importance that Aruba is present when consumers decide their holiday destination. We have the advantage that Aruba is a relaxation and recreation destiny for those wanting to relax after stressful times.” Another advantage according to Smith is the large number of timeshare accommodations whereby the island is assured of a fixed number of tourists.

You are so obviously wrong in your argument because you are blaming the victim. You have no empathy or sorrow for the victim and her family. This is always the stance of the guilty.

You should not treat those who come to your country with such contempt. No one in their right mind is going to respond well to "Hurry up and give me your money and you've not given me enough, we hate you and if something bad happens to you here then you deserved it."

That really makes me want to go to a Hell hole like ARUBA - a flat wasteland full of prostitutes and drug dealers.

You obviously don´t have all your facts straight. You should know that you are wasting your time as our island is doing better than ever and we should probably thank the Hollaway family especially Mrs. Twitty for all the free publicity getting her picture taken having fun in the casinos while ¨looking for her daughter¨ I think that makes it pretty clear that you just can´t help having fun on Aruba.

I don´t know where you get that we are in need of human rights. People here are very happy and we travel all the time in this new invetion ¨the airplane¨ I think it´s called.

We do of course live of tourism and that´s why we are very happy to speak four languages and be able to host guests from all over the world. Who we treat with respect and are very happy to help with their every whim. That´s what a vacation is after all. The people who have visited us for so many years some 20, 30 or 40 years are still happy to visit and the new guests that come out of curiosity about the case or any other reason istantly falls in love with the Island and can´t wait to come back.  

But people have to use common sense. 

You are a mom and probably have though your kids not to take drinks from strangers not to get in the car with strangers (I hope) more so if you are not home. It´s not that I blame the victim because of course the blame goes to Joran for being such a big idiot when he knew better not  to take 1 of 200 americans who come crawling out of bars everyday with him.

Anyways I do not plan to keep having this crazy discussion, I just wanted you to know that what you are doing is a waste.

THOUSANDS SOUND OFF ABOUT THE NATALEE HOLLOWAY MOVIE

Lifetime Movie Network’s new film “Natalee Holloway” takes viewers back to Natalee’s final days in Mountain Brook leading up to her senior trip to Aruba - then into what are now believed to be her final hours. 

The movie stars Michael J. Fox’s real life wife Tracy Pollan as Beth Holloway Twitty…a mother desperately searching for her daughter, a process that is still ongoing.  The movie, which originally aired Sunday night, is based on Beth Holloway Twitty’s book, Loving Natalee: A Mother’s Testament of Hope and Faith.

Hundreds of viewers have now posted comments on the Lifetime chat boards, sounding off about the movie…everything from support for Natalee’s family and frustration at how the Aruban government handled the case - to anger about the way the Aruban people and the island have been portrayed.

Birmingham attorney Charlie Ratcliff was born in Aruba but now lives here. He says Natalee’s disappearance is still a difficult topic for folks in Aruba.

“To say it’s been devastating to the island is an understatement. Devastating emotionally. A lot of people are heart broken and horrified one of our guests was missing,“ says Ratcliff.

At the end of the movie, the real Beth Holloway Twitty warns parents about how to prepare a safety plan for a child’s trip abroad - lessons she learned fast the hard way.

Lifetime does plan to post the movie, so folks who missed it can watch it online.

A LOOK AT THE NUMBERS

Lifetime Movie Network’s premiere of “Natalee Holloway” Sunday night ranks as the highest rated and most viewed movie in the network’s history.

“Holloway,” based on the novel “Loving Natalee: A Mother’s Testament of Hope and Faith,” scored a 1.8 rating and 3.2 million total viewers among viewers P+2. That bested the second part of “Capture of the Green River Killer,” which scored a 1.5 rating and 2.4 million viewers P+2 in March 2008.

Sunday night’s premiere also was the highest rated telecast among women 18-49 in all of basic cable over the last 12 months, scoring a 2.5 rating and 1 million viewers in the demographic.

In addition to total viewers and women 18-49, the film also set network records among households (3.4 rating, 2.4 million households) and women 25-54 (2.7 rating, 1.1 million viewers).
