KALPOE'S ATTORNEY VOWS TO "TAKE DR. PHIL DOWN!"

LOS ANGELES (AP) — A judge refused to dismiss a defamation suit Tuesday against CBS and television psychologist "Dr. Phil" McGraw.

William Cremer, the lead attorney for the Kalpoes said, "I'm going to take Dr. Phil down," he said outside the courtroom.

The ruling came a day after ABC's 20/20 aired the secretly recorded conversation involving Joran Van der Sloot.

The Kalpoes are suing for defamation, invasion of privacy, emotional distress, fraud, deceit and civil conspiracy.

Cremer said the taped remarks by Van der Sloot, help his clients' defamation case. "It pretty much exonerates my boys, doesn't it?" Cremer said.

In their dismissal motion, attorneys for CBS Television and McGraw maintained lawyers for the Kalpoes did not meet deadlines to produce all documents they have demanded concerning the criminal case investigation against the brothers in Aruba.

The judge gave the Kalpoes' lawyers another five days to satisfy the document deadline. "The documents are relevant to the most fundamental issues in this case," Ferns stated in his ruling. "There is no other (information) which can substitute for the documents sought by the defendants due to the nature of this case."

COULD IT BE POETIC JUSTICE?

After examining all the legal angles of the Kalpoe/Dr. Phil case I decided get some legal advice from Steven Snider, a criminal defense attorney out of Atlanta, Georgia.


Michelle:

If the Plaintiffs (Kalpoes, et al.) do not come up with the discovery as required, the Defendants (Dr. Phil, et al.) can move to dismiss the case. Most likely the judge will grant the motion and order the case to be dismissed with prejudice. If this happens and the Kalpoes are in default, can Dr. Phil's attorneys file a motion with the Court ordering the Kalpoes pay their (Dr. Phil's) attorney fees? Am I correct?

Steven Snider:

Yes. That is only if Dr. Phil's attorneys wish to pursue that. In order to do so they would have to file a motion with the Court showing this was a frivolous lawsuit, had no merit, and was a waste of the Court's time and taxpayers money. If the Judge agrees to the motion, he/she has the SOLE DISCRETION to order that the Kalpoes PAY Dr. Phil's attorney fees.

Michelle:

Not to mention they could responsible for their OWN attorney fees, right? (Unless someone was paying their bill all along, but I'm rooting for contingency.)

Steven Snider:

It is depends on what has been stipulated by the Court and how the parties wish to handle it. But yes, in the worst case scenario those boys are screwed.

Michelle:

(Jumping with elation...) YES! If the Kalpoes were taken on as clients under contingency that means the Kalpoe attorneys fronted all the money to put this lawsuit in place: the filing fees, man/woman hours putting the case together, money spent on phone calls, faxes, copies, retrieving records, etc. That adds up $$$ and they will want to recoup that...as you know attorneys want their MONEY!

CBS Access To Holloway Files

(CBS) LOS ANGELES Lawyers for CBS Television and "Dr. Phil" McGraw can have access to e-mails and Aruban documents about two brothers arrested, then released, in the disappearance of Alabama teenager Natalee Holloway, according to a ruling obtained Wednesday.

Deepak and Satish Kalpoe allege they were defamed in a Sept. 15, 2005, "Dr. Phil" show during which it was alleged that they gave Holloway a date-rape drug and had non-consensual group sex with her. The episode also implied the siblings helped kill Holloway and dispose of her body, according to court papers.

Los Angeles Superior Court Judge Edward A. Ferns issued a 12-page ruling Friday that upheld the tentative ruling he reached in favor of CBS and the celebrity doctor before he took the case under submission Aug. 30.

"The documents are relevant to the most fundamental issues in this case," Ferns stated. "There is no other (information) which can substitute for the documents sought by the defendants due to the nature of this case."

Ferns stated it is not important that the majority of the documents sought by CBS and McGraw attorneys are in the hands of Aruban authorities.

"Most, if not all documents originated in Aruba, simply because that is where Natalee Holloway went missing and where the criminal investigation arose," Ferns stated. "The competing policies of California and Aruba would not be undermined by production (of the documents)."

Attorneys for CBS and McGraw maintain they need the information to refute the Kalpoes' defamation suit filed last Dec. 13. But lawyers for the brothers say much of the information the defense wants is in the hands of Aruban authorities, who they say have refused to release it until the investigation is complete into Holloway's disappearance.

Holloway was vacationing with friends on the Caribbean island resort when the 18-year-old vanished the night of May 30, 2005.

The Kalpoes and another Aruban resident, Joran van der Sloot, were arrested in the girl's disappearance but later released.

The Kalpoes and van der Sloot have maintained that they were not involved in her disappearance. They denied rumors and allegations they had sex with her.

Attorneys for CBS and McGraw claim documents exist showing the Kalpoes admitted to both Aruban authorities and to van der Sloot that they had sex with Holloway.

In a separate declaration to Aruban police, van der Sloot said "that he thought ... Deepak Kalpoe had raped the girl and thereupon murdered her," according to the defense's court papers.

The CBS/McGraw lawyers also want copies of all e-mails between the Kalpoes and other people regarding the case.

Edmund J. Siegert, an attorney for the Kalpoes, said during the Aug. 30 hearing that he is "between the old proverbial rock and a hard place" because his ability to comply with Ferns' order is dependent upon what Aruban authorities decide to give him.

"No one wants to thumb their noses at any of the institutions here," Siegert said. "I'm trying to balance ... and not get anyone in trouble with any tribunal."

But defense attorney Charles L. Babcock said during the same hearing that the lawyers for the Kalpoes were being "duplicitous" in their arguments because Aruban authorities have often discussed the Holloway case in the media.

"When it helps them they will solicit statements from authorities in Aruba about this case," Babcock said.

In another ruling today Ferns has now made final, the judge denied a motion by the CBS/McGraw attorneys to dismiss the estate of private investigator Jamie Skeeters as a defendant in the lawsuit.

The Kalpoes allege that associates of McGraw sent Skeeters to Aruba to develop material for a segment of the show dealing with the Holloway case.

Skeeters, using a family friend and co-worker of Deepak Kalpoe, gained his confidence by saying he could help exonerate both Kalpoes of any wrongdoing in the Holloway case, the suit states.

Skeeters then secretly videotaped and recorded an interview with Deepak, according to the suit. Part of the interview was broadcast during the "Dr. Phil" segment, including statements the suit maintains were "significantly manipulated and altered."

Skeeters died Jan. 24.

In addition to defamation, the Kalpoes' suit alleges invasion of privacy, emotional distress, fraud, deceit and civil conspiracy.

The CBS/McGraw lawyers maintain the Kalpoes are public figures who are obligated to show the defendants knew the statements during the "Dr. Phil" episode were false, or that they acted in reckless disregard for the truth.

A case management conference is set for Nov. 7.

On June 1, another judge dismissed a wrongful death case against the Kalpoes by Holloway's parents, ruling the Los Angeles Superior Court did not have jurisdiction. The parents maintained the brothers conceded jurisdiction when they filed their lawsuit in Los Angeles against CBS and McGraw

THE KALPOES VS. DR. PHIL-- WHAT'S GOING ON?

Any word on the lawsuit? I'm betting on NO WORD. Am I right? I realize all civil lawsuits that go into litigation can take a long time, but let's consider this case. It's not a simple situation. I am sure each attorney is throwing down motion after motion on all the different subject matter and procedural issues; jurisdictional issues such as Deepak not being a U.S. citizen, yet the interview takes place in Aruba, Jamie Skeeters, a defendant, is now deceased. As someone who used to work in civil litigation, I can promise you that all these things will delay and delay and delay...and I can see this case drag on for YEARS. UNLESS someone settles...and I would HOPE Dr. Phil would never do that! Assuming that doesn't happen, I would be very surprised if we hear anything anytime soon.


But remember this... it always must be on the backs of our minds...Deepak et al are trying to cash out on this cow, but WE CANNOT ALLOW IT!

This following video made me laugh out of my chair. While browsing the net I catch this old clip of Geraldo on Bill O'Reilly discussing the infamous Deepak/Skeeters tape. You all know my opinion in that regard, (Read HERE for an old interview I had with Beth regarding the "Skeeters Tapes") so I won't go on any tirade. Stop the boycott against Aruba with lawsuits in the U.S.

ORANJESTAD (AAN): Recently, a possibly boycott by the environmental organization was cancelled by a contract signed by Bouldin and Lawson. Contrary to what Minister Wever insinuated, Rainbow Warriors International is working in the general interest of Aruba and the rest of the world. This is what Milton Ponson declared last Tuesday night to DIARIO.


The word was that organizations from abroad with the contract of Bouldin an Lawson will be dealt with in House of Commons in Holland and that they will use country regulation publicity of governing board in Aruba and Law publicity of governing board in Holland to bring out ALL documents to the public. Contrary to what Minister President Nel Oduber wants, giving only ‘for inspection’ document, our organization is of the opinion that the members of parliament of Aruba have every right to demand and obtain copies of ALL documents so that they can control the executive power.


Otherwise, it is then MEP and Minister President Nel Oduber and his cabinet that are rightly managing a banana republic and are giving all the American media who are supporting the boycott called by Governor Riley and Beth Twitty, good reason to call our country corrupt. According to Ponson, their organization supports a conversation with Mr. Jaap Baujon, member of the Strategic Communication Task Force and offers their services free of charge to help disarm the boycott called against Aruba.


Rainbow Warriors International has ample experience on the topic of boycotts and contrary to what the human rights expert Mrs. Henriquez, the lawyer incorrectly said that any person, group or organization can call a boycott, which in essence is a call for consumers to NOT purchase certain products or services, in the case of Aruba the product is the trip and stay in Aruba. An economic sanction IS what the United Nations General Assembly can enact against a country.


Because of this, any attempt on the part of the Aruban community to let the United Nations intervene is useless, given that we are dealing with a ‘consumer boycott’. We are in agreement with Mr. Bob DiLella, political consultant of the MEP party, who declared in an article published on November 21, 2005 in Amigoe, that we have to become more aggressive.

To take away Beth Twitty’s strength, her defamation campaign has to be attacked as much as the media who support it as with elected officials, for example governor Bob Riley of Alabama. Litigation is underway now, where a lawsuit has been initiated, given that among others, Dr. Phil indicated that he is NOT interested in giving the opportunity for ‘rebuttal’, and he isn’t either interested in ‘fair and accurate news coverage’.

It would be good for everyone to realize who Phillip McGraw, better known as Dr. Phil, is. He is co-founder of Courtroom Sciences Inc., a company of litigation consultants which helps big companies that appear on the famous Fortune 500 list, to win cases in court. It is Dr. Phil’s company who saved Exxon Mobil from paying an insurance claim of more than USD$600 million for the biggest petroleum leak in Alaska’s history with its Exxon Valdez. It was Dr. Phil who saved Oprah Winfrey’s skin, when she had a multi-million dollar lawsuit against her, after Oprah Winfrey proposed to stop eating beef, due to the risk of mad cow disease.


Undoubtedly, Dr. Phil’s company is assisting Mrs. Twitty in the background. The time has come to grab the bull by the horns and stop pretending that this issue will disappear. Our opinion as an organization with experience in the boycott arena is to declare that all signs point to this being simply the ‘warm-up phase’.


If the MEP government and others want to be political ostriches (with their heads in the sand) ALL in Aruba end up harmed. Enough with pretty letters to Minister Bot, protests at the Plaza Betico Croes and Open Letters in the press. It is time to act!!! Ponson proposes lawsuits against the media who do not want to provide us with rebuttals and/or fair and accurate news coverage.

I have followed the Natalee Holloway case closely since it began. While free speech is to be encouraged, the tone of your article, which appeared online this morning, is so one-sided that I am forced to believe that your intention was to denigrate Natalee's family.


You say the Holloway Twittys have cast Aruba's "police force as inept bunglers." Well, let's see ... within 48 hours of Natalee's disappearance, Beth Twitty had arrived on the island, reviewed the videotapes at the Holiday Inn where Natalee had stayed, proved conclusively that the lies of the three suspects about returning her to the hotel were just that -- lies -- and had shown those same tapes to Aruban police.


Who had Aruba seen fit to arrest? The three people last seen with Natalee? No, two security guards who had never been seen in Natalee's company and who were singled out by the suspects themselves.


What was Aruba's reaction to Beth Twitty's proof? To do nothing for another week. Sterling proof of the quality of law enforcement on Aruba, wouldn't you say?


(Incidentally, your comment that "investigators no longer seem to be focusing on the three named suspects" has neither attribution nor logic: a court for the Netherlands Antilles recently ruled that the three remain suspects. The court also struck down damages that Paulus van der Sloot had claimed, saying that witnesses had placed him in Natalee's company on two occasions on the night that she disappeared.)


You speak about "the ill fate presumed to have befallen Natalee Holloway" and sneer at the "vigilante justice seekers." Obviously it's ridiculous to think that, simply because an honors high-school student with a full scholarship to medical school has been missing for two years, foul play could be responsible. Equally ridiculous is the idea that anyone seeking justice -- which the family has interpreted as simply wanting answers to their daughter's fate -- could be motivated by such things as belief that an American missing abroad is a matter of some importance. Why see a potential threat to other tourists? Why not do what Dennis Jacobs said to Dave Holloway (after asking how much money he had ... a normal response from a dedicated law enforcement officer, I'm certain): go to the bar and have a beer?


You seem to accept as fact Aruba's assertion that the damage from the economic boycott has ended. Were you interested, I could direct you to article showing that the decline is both more severe than Aruba has acknowledged (assuming that you trust Aruba's figures to begin with) and is continuing.


My understanding is that the Aruban government gave civil servants an afternoon, not a day, to join the search. And according to an AP article, participation was far less than Aruba put it.


The attorney for the Kalpoes, one of whom said on the Dr. Phil show that Natalee was a "slut" and dressed "like a slut," laments that his clients have had "this sword over their heads for two years now." The Holloway Twitty family has had a different sword over their heads for two years ... the agony of wondering what befell their daughter. I know which plight is more deserving of sympathy, in my eyes.


Perhaps you would care to detail the scores of lies that we have gotten from the three suspects. Given that Joran van der Sloot has given at least four explanations of how he got home from the beach where he said he took Natalee (though he also said he took her to his house), some people might think his actions merit suspicion. And given his father's now-famous phrase, "No body, no crime," those suspicions might be extended.


Your nearly page-long coverage of the "compassion for a desperate mother" that Julia Renfro is alleged to have felt omits a few facts. Such as Joran van der Sloot's statement that he had sex with Natalee while she was drifting in and out of consciousness. Some people might define that as rape.


And Renfro's speculations about what Natalee might have done conveniently try to take the focus off the three suspects ... whom former Chief of Police Gerald Dompig has said are "guilty as hell." A drunken Natalee, left on the beach, is going to swin to one of the nearby boats? No writer for a sixth-grade newspaper would let such an absurd claim go unquestioned.


I am not going to discuss my ideas of what happened to Natalee Holloway. But I might suggest that you balance your pro-Aruban account with a little background.


Such as: the FBI agents sent to Aruba were outraged that they were being slighted, not allowed to do anything useful, and were kept out of the picture.

Such as: far from being sympathetic, the Aruban government lied about the support it was giving the family (Dave Holloway is on record as denying the free rooms and other benefits).

Such as: a water search was on the verge of being launched, and all that Aruba had to do was contact the FBI. It refused to do so.

Such as: the Aruban government's sympathy did not extend to Beth Twitty, whom it told would have to apologize for her statements or it would stop its investigation.

Such as: Arubans demonstrated in the street against Beth Twitty. (Did your self-commiserating Arubans, sad at the impact of this tragedy on their businesses, see fit to mention this?)

Such as: an unqualified, specific promise from Steve Cohen, one of the many functionaries who tried to represent the Aruban government, that the three suspects would be re-questioned. It never happened.


I could cite dozens more issues. But why bother? I do not speak for the Holloway Twitty family. But your totally one-sided article leaves me doubting that they would speak to you.


I appreciate your attention and assistance on this matter.

Tim Miller and the Texas Equasearch team are going back to Aruba for more intense water searches in late June. Let's hope the Caribbean weather forecast for this upcoming hurricane season is wrong or Tim Miller might have a very hard time accomplishing anything.


Aruba claims that they haven't been affected by a hurricane in over 100 years...but there is a little-known fact about Aruba: In 2004, Hurricane Ivan came close enough to Aruba to cause wind damage and high tides. "Ivan began to rapidly intensify again and became a Category 5 hurricane just north of the Windward Netherlands Antilles and Aruba on September 9 with winds reaching 160 mph (260 km/h)." (Source)

Another Legal Recourse?

We know now that the California judge dismissed the wrongful death suit against the Kalpoes...Beth and Dave's alternative recourse? The Holloway's can file a wrongful death suit in Aruba...but here's the Catch 22: They wouldn't be allowed to use ANY of the police documents or statements that the three boys made. And of course, you know the Arubans won't cooperate.

TWO YEARS LATER--WHAT HAVE WE REALLY LEARNED?

Unfortunately, it has been two years since Natalee Holloway vanished after last being seen with Joran van der Sloot and the Kalpoe brothers. Within the past 24 months an astounding amount of information has surfaced, yet nothing has happened. No one has been prosecuted. The media fed and continues to feed lies and teasers; Aruba feeds more lies and unseen “fireworks”.


We learned that Joran came up with approximately 20 different lies about what happened that night with Natalee. We learned that the Kalpoe brothers not only have many lies, but different accounts as to what happened to Natalee. We learned that Joran’s father was involved in Natalee’s disappearance. His involvement may never be known, but we do know that he not only lied, but was implicit in the cover-up and ongoing conspiracy of Natalee’s disappearance. We learned the infamous phrase, “No body, no case”. We learned of Paulus’ “clout” on the island as well as his best friends, business colleagues and dirty connections.


We learned of Steve Croes, the false witness who lied in order to put two innocent security men behind bars. We learned of other witnesses that came forward, yet mysteriously “disappeared”, retracted their statements, or were deported for unknown reasons.


We learned that Natalee was declared dead on June 10, 2005, yet later the statement was retracted. Did she miraculously rise from the dead? Who was the “dead person” they found?


We learned about and watched the “Arubay videos” and the infamous missing video that could blow the case open which a man named Ed Smith claims to have. We learned that the Aruba Visibility Team was at the scene where the footage was taped and “something” was found. Rocks were painted with an unknown substance. Items of importance or possible forensic evidence were found and quickly discarded like used tissue. A picture of a white garbage bag with something eerily human inside surfaced on the internet and in the American papers. A man was photographed carrying a scrap of material matching Natalee’s shirt. A bone was found. We were told things were sent to Holland for forensic testing, yet we heard nothing.


Suspects came and went like a revolving door…yet nothing surfaced. It is Aruba’s longest running “circus festival”…will we ever see a just and fair finale?


We learned that the police investigator Gerold Dompig stated that the three boys were “guilty as hell”. We learned Dompig is related to a well-known local “beach bum drug dealer” and the Kalpoe brothers. Dompig’s son, Michael, who was also known to hang out with “the pimps” told a source that hours before Beth Twitty arrived on the island he saw Joran, Koen Gottenbos and Deepak take Koen’s boat out into the ocean. Dompig ended his career after he went on national television and stated that Natalee likely died of an “overdose”.


We learned that Aruba has suffered greatly because of this tragedy that did not have to escalate. The boycott of Aruba has stymied their economy and their reputation has been forever damaged.


Yet, with all this information and much more that could fill a book (and that book is called Aruba: The Tragic Untold Story of Natalee Holloway and Corruption in Paradise) NOTHING has happened.


We are now waiting on the Dutch to decide Natalee’s fate. Will she receive her due JUSTICE? Will Joran et al walk away scott free? What will come of the Kalpoe’s lawsuit against Dr. Phil and Dave and Beth’s suit against the Kalpoe’s for wrongful death? Will we ever really learn the truth? Will Natalee ever really receive justice?


Two years is a long time to lie…the consequence of continued lying? The INDEFINITE boycott of Aruba and everything Dutch.

Aruban Brothers Want Natalee Holloway Lawsuit Dismissed

LOS ANGELES -- A lawsuit filed in Los Angeles against two Aruban brothers by the parents of missing Alabama teen Natalee Holloway should be dismissed on grounds the case has no connection to California, the siblings' lawyers argue in court papers obtained Tuesday.


Los Angeles Superior Court Judge George Wu will consider the motion brought on behalf of Deepak and Satish Kalpoe, but no date was immediately set. The next scheduled hearing in the case is April 2.


The brothers' attorney, Kristina M. Beck, filed court papers last Tuesday in support of the dismissal. The Kalpoes and another Aruban resident, Joran van der Sloot, have been the subject of scrutiny by Aruban authorities and the U.S. media. All three were arrested in connection with the Holloway case and later released.


Beck's court papers state that an important ruling occurred Jan. 24, when another Los Angeles Superior Court judge, Edward A. Ferns, ruled that the wrongful death claim of the teen's parents against the Kalpoes is substantially different from the siblings' defamation case against "Dr. Phil" McGraw." These actions do not arise from the same or substantially identical transactions, happenings or events...," Ferns wrote, in ruling that both cases should not be kept before the same judge.


The Kalpoes sued McGraw and CBS Television on Dec. 13, alleging they were defamed in a Sept. 15, 2005, show dealing with the still-unsolved case. Although the Kalpoe brothers had been released from Aruban police custody, the "Dr. Phil" episode suggested they gave Holloway a date rape drug and had non- consensual group sex with her, according to their lawsuit. The episode also implied the siblings helped kill Holloway and dispose of her body, according to the lawsuit. The Kalpoes and van der Sloot have maintained that they were not involved in her disappearance and did not have sex with her.


In addition to defamation, the Kalpoes' suit alleges invasion of privacy, emotional distress, fraud, deceit and civil conspiracy. Natalee Holloway's parents, Elizabeth Ann Twitty of Alabama and Dave E. Holloway of Mississippi, filed a wrongful death suit against the Kalpoes the next day, even though their daughter's body has never been found and Aruban authorities have not determined if she is dead or alive. Natalee Holloway was vacationing with friends on the Caribbean island resort when the 18-year-old disappeared the night of May 30, 2005.


Twitty and Dave Holloway, who are divorced, maintain that by bringing an action against McGraw in Los Angeles, the Kalpoes voluntarily submitted themselves to the Los Angeles Superior Court jurisdiction. But in her court papers, Beck argues that Twitty and Holloway are not part of the defamation case; that the alleged misconduct by the defendants in the lawsuits occurred in two entirely different locations -- Aruba and California; and that one suit involves wrongful death and the other defamation.


In support of her motion, Beck attached to her court papers a declaration by the Kalpoe brothers' mother, Kemwattie Ramirez, stating that her sons live with her in Aruba and have no ties to California."Neither Deepak nor Satish has ever traveled to California, or anywhere within the United States, for business or pleasure," according to their mother, who also said her sons have no business, employment of financial ties to California. (Is this the same mother who said, "Everybody lies"????)


Twitty and Dave Holloway also filed a wrongful death suit last year in New York against van der Sloot and his father, but a judge there also threw it out for lack of jurisdiction. Meanwhile, a motion is set before Judge Ferns on Thursday in the defamation case.

JAMIE SKEETERS--TO THE MAN I NEVER MET

Between this blog and my other blog, Michelle Says So, I am always reading, posting and concentrating on negative and terrible things that happen to other people. I've seen it all...I've read it all. Everyday I read about everything from murder to rape to missing people and grieving families... Death and horrific events that happen to "other people" has certainly put things in perspective for me. Especially when someone like Jamie, who could be my dad's age dies so suddenly and unexpectedly. Just remember...we could be one of them at any time.

Yesterday, I attended the funeral of a man that I had never met before. I went in honor of a friend and former co-worker of mine, who's father suddenly passed away. I had heard a few stories about him and I always noticed the twinkle my friend's eye whenever she spoke of him. I knew my friend would be devastated by her father's sudden passing, so my husband and I drove 2 hours in the pouring rain, to show our support and try to offer her some comfort.

During the funeral, numerous mourners stood up and talked about the man I had never met before. They spoke, one after another, about his generous nature, caring heart and sense of humor. For nearly 2 hours his friends and family sang his praise and reminisced about his incredible zest for life.


After only a few minutes, I found myself laughing, crying and grieving right alongside his closest friends and family. Throughout the service, I learned about the hundreds of lives he touched and his frequent altruistic acts while serving nearly 30 years of service to the Oxnard, California community. This once Marine Sergeant was also a police officer, a founding member of the Oxnard Police Department SWAT team, a member of the Ventura County Narcotics Task force, a founding member on the Governor's Task Force against Sex Offenders and he later became a licensed polygraph examiner. This guy was busy. But never too busy to help a friend in need or call his daughter a couple of times a day, just to say, "I love you."


By the time the service was over, I too, was grieving for the man that I had never met before.


And while he managed to touch so many lives while he was alive, even in his passing, he somehow touched a few more. I know my husband and I walked away from the service, inspired to become better people.


I think a good exercise in improving yourself... would be to simply think about what you would want your loved ones to say about you, at your funeral.

DR. PHIL'S LAWYER RESPONDS TO K2 BROTHERS

(Source)--LOS ANGELES - Two brothers who filed a defamation lawsuit against the "Dr. Phil" show for airing a segment about their roles as former suspects (WTF??? Get your facts straight Associated Press! THEY ARE STILL SUSPECTS!) in the disappearance of Natalee Holloway should not be entitled to punitive damages, an attorney for the show said.

Deepak and Satish Kalpoe, both residents of Aruba, filed the suit in December seeking unspecified damages against talk show host Phillip McGraw, CBS Television Distribution Group and private investigator Jamie Skeeters. (Good luck getting anything out of Jamie. Those bastards are probably inadvertently culpable for his premature death, too...)


The lawsuit alleges the show altered portions of a secretly recorded conversation between Deepak Kalpoe and Skeeters to "create false, incriminating, and defamatory statements that the plaintiffs engaged in criminal activity against Natalee Holloway." (I don't think the sentences, "So, you all had sex with her? Good for you..." and "Yeah, you wouldn't believe how easy it was that night..." were false statements. They came DIRECTLY out of Deepak's pie hole! Argue the tape ALL YOU WANT...the symantics and other words used surrounding those sentences prove Deepak's response is completely logical!)


William Haggerty, an attorney for McGraw and CBS, said in court papers filed Friday in Los Angeles that widespread news reports of the brothers' arrest "serves to mitigate any damages allegedly suffered by them and bars or reduces their right to recover any damages." Haggerty also denied his clients intentionally misrepresented any fact to the brothers or acted with malicious intent. Skeeters is being represented by a separate attorney. (Looks like the AP failed AGAIN to check their facts and note that Jamie recently passed away. Why is it that we, the bloggers and those who help find the FACTS are doing this for free out of the goodness of their hearts, while some numb-nut who has no idea what is going on gets paid good money for this misinformation?!?!)


An after-hours telephone message left Monday for the attorney representing the brothers was not immediately returned. (Of course not! That's a no-brainer...)


Holloway was 18 when she disappeared on May 30, 2005, while on a trip to Aruba with classmates from her Alabama high school. She was last seen getting into a car with the brothers and their friend, Joran van der Sloot. Police spent months searching for the missing teen, but the case did not lead to any criminal trial in Aruba. (Not due to lack of evidence or blatant lies and corruption...things like that don't lead to criminal trials in Aruba!) The brothers were released from police custody following their arrest and have not been charged in the case. (But remember, they are STILL SUSPECTS!)

MERI'S BACK--HONEST LEGAL OPINION

I haven't had much to say as of late but I wanted to voice my opinion on a few things.

The Dr. Phil Show is filmed in the United States and therefore any civil wrong-doing that someone may have perpetrated during the course of that show and that might have harmed the Plaintiffs (the Kalpoe's in this case), will give them legal jurisdiction.


This is quite different from the lawsuit that was attempted in NYC regarding Joran and Paulus as the accusations of various crimes happened on Aruba and NOT in the USA. There was never any personal jurisdiction here in the USA and the suit could only be heard on Aruba (which I doubt would have ever happened having viewed their judicial system and how they interpret it).


There was also the closely knit relationships among the Judges (the Court) and the parties involved. I don't think that any lawsuit would be a success on Aruba regarding this case.


As for extradition; Ramm is right. You can't extradite on a Civil matter. It is difficult enough to extradite on a criminal matter where evidence is clear; especially where treaties are in place.


That is where Ramm and I part ways.....as for his association with BFN and some of the people there, we totally disagree and I find that many of them have a strange way of showing support for Natalee and her family.


I NEVER believed for one second that Ramm had any sort of legal background or knowledge, but he is entitled to his opinions no matter how different from my own. He does come across as if he is an "expert" on certain subjects which I find amusing but harmless. He, like many of us have no actual standing in this case and all we can do are the following: offer support, help with the boycott movement; or do research so that we can impart a better understanding of the particulars involving this case and the places and people in the cast of characters.


Truth be told, other than some very good articles on various Internet sites, this boycott site, and some kind and compassionate people who have stood alongside the family, most of us have contributed nothing.


We have shown our compassion in many ways and hopefully, that has been a help to the family as they go through this long, drawn-out, exhausting process of trying to find the truth as to what happened to Natalee Holloway.


There are a few people working on some areas that may someday bring some International attention to Natalee's plight, but that hasn't happened as of yet.


As for the Kalpoe's and their lawsuit....it isn't as frivolous as it may appear at first glance. I don't believe one single word that comes from the mouths of the Kalpoes'. Joran, Paulus and the rest of the bozos on Aruba, but I DO know that Dr. Phil messed up. He made some unsubstantiated claims on his show and he has not been able to prove what he said. He based his comments on a tape that may or may not have been flawed and was most definitely edited. That alone means that the Kalpoes' may actually have reason to believe that they were Civilly injured.


Even the FBI has not supported the veracity of the Skeeter's tape and therefore we have no idea who said what to whom and what was true or edited. I doubt that the case will ever go to Court for trial and I believe that the powers that be at The Dr. Phil Show will settle this case with the Kalpoe's.


Frankly, the thought of them profiting from this situation makes me feel sick but the law is the law and Dr. Phil did damage not only to the suspects but to the entire case when he butted in. He simply did not have enough facts (no one does except for those who know the truth). Therefore, he left himself and his show open for a Civil action.


I hate to quote a television show, but it makes sense to listen to what Gil Grissam of CSI says when he states, "We always follow the evidence". In this case, most of the evidence has been lost, destroyed or never gathered.


After all this time, I still believe that Joran, the Kalpoes, some of their other associates, his father and others on Aruba know what happened to Natalee and I do NOT believe the "I left her on the beach story".


Do NOT be shocked or surprised if the Kalpoe Brother's DO profit from their lawsuit....it is not much of a stretch to picture them winning some kind of settlement since Dr. Phil was careless and since the tape that he used on his show was edited. They can be as guilty as hell and still win their suit.....it all depends on what was said, how it was said, the intent of what was said and what evidence there is to back-up their claims.


If it can be proven that Dr. Phil based his comments on an unproven video and audio tape and that the tape was not used in it's true content...therefore inflicting harm on the Plaintiffs....BINGO.


I will feel ill if the Kalpoes' are victorious but I will not be surprised.

SUE HAPPY KALPOES TRY TO CASH IN ON THEIR CRIME

Sue! Sue! Sue! It has just been reported that both Satish and Deepak Kalpoe are suing Dr. Phil for the alleged 'tampered audio tape' of Jamie Skeeters and Deepak that was aired on the Dr. Phil show last year. In addition, John Q. Kelly filed a wrongful death lawsuit in California against the brothers. More details to follow. Why is Satish suing? He wasn't even involved in that taped conversation? I'd like to know what their cause of action is and where they are filing suit...which jurisdiction? This should be interesting to say the least.

I don't know how it can be PROVEN the tape was altered. I also don't know how or why JQK is choosing California as the state of jurisdiction to file the wrongful death action. Is this more money wasted full of empty hopes???

One-on-One with Beth Holloway-Twitty

When I spoke with Beth, she was on her way to the Alabama's governor's mansion for the candlelight vigil given by Alabama's first lady. Beth is a woman who is on the go 24-7. I never realized that a mother who is going through so much pain could still have the stamina and perserverence as Beth does. She's a very pissed off mother with a major mission. However, the stress has taken a huge toll on her. Since June, she's plummeted from a size 6 to a size 0.

Now she's battling her latest quandry: the defaming Vanity Fair article in which Gerold Dompig claimed that Beth's interference with the investigation is the reason why they haven't found Natalee. I could feel the anxiety in her voice, so I asked, "How are you feeling, Beth?" She said quietly, "Not good...it's rough. Very difficult." I asked her if she knew in advance that the Vanity Fair article was coming out. She explained that she knew about the article, but had no idea the piece would be so mean-spirited and evil to the fact that he would blame the family. Looks to me that we are seeing the true colors of media...ratings and money. Nobody wants to hear the angle of an anguished mother...they want to read the dirt. Whether the statements made are correct or false...people seem to have that unconscious desire to hear about someone's loss or tragedy and will pay money to read the blasphamous garbage.

Beth has not been "banned" from Aruba, but on October 18, 2005, she received a phone call advising her not to return to the island because Aruban officials would place her under arrest. Arrest? For what? She explained that she has been threatened to be arrested because she called Joran, Satish and Deepak 'criminals' on national TV; in addition to coming forward with the fact that her original written statement to the police was changed and 'falsified'. Evidently, those Arubans are squirmish about which words you use. Mainly because they don't have the capability of understanding the difference.

"Is it falsified or altered? Is it edited or manipulated?"

Aruba doesn't have freedom of speech, and they can't stand the fact that Beth has used the media to state her position on the lack of professionalism and possibly conspiracy that Aruba is pulling over. Aruba would have felt a whole lot cozier if Beth said her statement was "altered". It's the typical example of damned if you do, damned if you don't. Aruba was pissed from day one because the americans came to their island and wanted answers. They claimed we were "taking over", because they weren't getting any answers or doing anything to further the investigation. Aruba's ego got in the way of a missing girl and it is their doing that this matter has gotten out of hand.

Michelle: What about the witnesses that originally came forward? The jogger? The gardner? The landfill witness? The girls who came forward stating that they were also drugged and raped?"

Beth: "It's fear. They are afraid of the repercussions. For example, they threatened to deport the gardner if he spoke. The aruban law says that they don't have to release ANY information regarding a criminal case if they don't want to."

Michelle: "I heard the jogger witness disappeared, what did they threaten him with?"

Beth: "The aruban police claim that they no longer have this witness's statement. They 'lost' it. And they don't know his name or where to find him. They claim he hasn't come forward again, so they can't do anything about it."

In a community of approximately 70,000 (smaller than my hometown), I am sure they can find the jogger...they probably know who he is, and I'm sure they threatened him to keep quiet. It makes sense...everyone who had information has suddenly disappeared or recanted their statements.

Michelle: Why doesn't Aruba release the tapes of their interrogations, copies of their interviews, DNA evidence, evidence taken from Joran's apartment, etc?

Beth: "Like I said, the ALE doesn't have to release anything...and they haven't. And they won't."

Michelle: Has the FBI gotten involved? Are they doing anything at the moment?

Beth: "No. I've gotten no help from the FBI yet. But I still have my aruban lawyer, Helen Lejuez."

Michelle: Were the bartenders at Carlos-n-Charlies questioned? The owner of the bar?

Beth: "No...not that I am aware of."

Wouldn't that be typical police protocol? Interview the business where she was last seen?

Michelle: "Have you used psychics, and have any of them been able to help or shed some light?"

Beth: I've used many, many psychics...obviously nothing has worked."

I suggested that maybe we should recruit the expertise of Medium John Robert...from "Crossing Over". It can't hurt. I plan on trying to contact him with this case.

Michelle: "Did any of the other students experience anything odd or weird while they were in Aruba? What about students from past years?"

Beth: "There have always been crackheads walking around harassing and threatening the students...but I haven't had the personal opportunity to talk to any of the kids or past students."

Michelle: "One of Joran's and PVDS's alibis was that Joran was picked up at the McDonald's. JVDS originally told you the first night you met him that he picked Joran up at 4:00 a.m., but he later gave a statement that he picked Joran up at 11:00 p.m. Do you know if there are security cameras in the McDonald's parking lot to prove this claim?"

Beth: "On June 5, we asked officials to check to see if there were security cameras, and to this day, nothing has ever been done. No one has looked into it."

Michelle: "Have you talked to Jamie Skeeters since the Dr. Phil tape fiasco?"

Beth: "Oh yes. I talk to Jamie all the time. He stands by his tapes. He's had 20 experts authorize that the tapes are real. I spoke with Dr. Phil as well. He is angry that the Aruban authorities claimed he manipulated the tape...when it was just 'edited' for tv time."

Obviously Aruba and Americans are not on the same page when it comes to vocabulary and comprehension.

Michelle: "Have you been privy or given copies of any court or police documents?"

Beth: "No. Back when the prosecutor did have communication with me, I was brought into a room where they read from dutch statements of many witnesses. I was not allowed to see the documents, but I wrote the names down."

Michelle: "They wouldn't let you see the actual documents? They READ them to you? How do you know what they were reading to you was true? Have you thought about revealing the information they verbally gave you?"

Beth: "No. I can't share that information."

Is Beth is still scared of Aruban authorities? They are the ones that hold the key to the answer of Natalee's disappearance, and it seems as if she's unconsciously trying to still please them while at the same time pursuing the investigation on her own.

Michelle: "Will Tim Miller and Texas Equasearch be coming back to Aruba any time soon?"

Beth: "Yes. Another search will be done, but they need correct information from the Aruban authorities on locations to search. To this date, they haven't been contacted and they can't come back and search without new spots to search or additional leads."

As for the other burning questions people have about the actual events of May 30, 2005, Beth does not have much information. She has been kept in the dark the entire time with all the details, and the ALE has NEVER given her any information. All the information she has gathered has been on her own...through the help of her own investigators and volunteers.

Why won't Aruba release any of their investigative information? They jump quickly to ensure they trash the evidence we collected, but won't give up any of their own information to prove anyone's innocence. They have been adamant about not helping the Holloway-Twitty family from day one...and completely apathetic about following up on leads and interviewing vital persons of interest.

I realize that the ALE and the U.S. have two different judicial systems, but it seems that their way of solving a case is something out of an episode of "Keystone Cops". They have a lot to lose by not revealing any information or helping this family out.

Final thought: When you leave the United States on vacation, you have NO RIGHTS anywhere. Especially in Aruba, where they can arrest you for any reason they please. Remember this when you plan on taking a vacation...you could end up being a victim and your family will be completely helpless.

I am reiterating to please avoid traveling to Aruba...there are many other beautiful islands in the Carribean in addition to gorgious locations all over the world. Does Aruba with their wildly available drugs, menacing drug addicts, and rampant date rapists sound like a vacation paradise to you? Doesn't to me. I'll think I'll pass...from now and forever.

The tapes of Deepak Kalpoe being questioned by Jamie Skeeters did not provide any new information for investigators. In fact, one tape that was of the interview run on the Dr. Phil show was "manipulated" according to forsenic experts.

Investigators certainly had hoped that the tapes might reveal more about exactly what happened that night on the beach. But this analysis by four independent forensic experts found that the phrase they wanted to hear was just not there.

Even so, Chief Dompig has asked, along with the prosecutor, for a review by the FBI.

Here are my questions to Arubatruth.com:

Where are the statements by these so-called experts claiming the tapes are indeed manipulated? If these were forensic experts, then why would Aruba need the FBI to go over the tapes? By the way, how was Aruba able to get 'forensic information' so quickly if they took their sweet time reviewing all the other evidence? And speaking of forensic evidence, what ever happened to the forearm bone found? Did your forensic experts find anything out about THAT yet?

Another CLAIM by Arubatruth:

It was clear that the family had the same dismay as investigators when the tape review was completed. Beth admitted that it was possible, without her knowledge, that the tape was altered or improperly edited.

My question to Arubatruth:

Where did you guys get this quote? Did you just make it up? This is what Beth really said about those tapes (FOX, November 27, 2005, Big Story Weekend):

"Well, I'm so glad I've had the opportunity to review this tape. I've seen it in it's entirety...the uncut copy. And yes Deepak does specifically say "She did and you'd be surprised how simple it was." I think what we're having trouble with here Rick is a language barrier. It's a semantic problem. The Dutch Forensic Institute has stated that the tape they received from the private investigator and from the fbi has not been manipulated. The one by Dr. Phil was not manipulated, it was edited for television. You can't have a 2 1/2 hour taped interview on a one hour program. We just needed a 30 second soundbite or a ten second soundbite."
